Presenter's Biography:

Admitted as a solicitor in England & Wales and in Hong Kong in 1995 and 1996 respectively. From 1996-2001 in general private practice. From 2001-2017, a magistrate in Judiciary and had been posted to Labour Tribunal for about 4 years, familiar with employment litigation
 
Objective:

The seminar aims at providing the audience with an understanding of the work and operation of the Labour Tribunal. The major areas of employment disputes will be examined.
 
Outline:

  • Brief induction about Labour Tribunal, e. g. general procedural for lodging claims, the role of Tribunal Officers, matters to be noted during trial and after trial;
  • Legal issues on:
    • Jurisdiction-Section 7 to Section 10 of the Labour Tribunal Ordinance & Section 32J of the Employment Ordinance
    • Contract of employment Vs. Contract for employment
    • Termination of Contract under Section 9, 10, 10A & 11 of Employment Ordinance
    • Employment Protection under Section 32, 32O, 32P of Employment Ordinance
