Presenter's Biography:
Gary was admitted as a solicitor in England & Wales in 1993 and practiced insurance litigation with several leading UK law firms over many years. He is also Called to the Bar in England & Wales.
Gary served as the Course Director of BPP Law School's Full-Time Bar Vocational Course (BVC) in London before joining the Faculty of Law at the University of Hong Kong in 2007. He currently teaches civil litigation and commercial dispute resolution on the PCLL programme and insurance law on the LLM, LLB and JD programmes.
Gary has written extensively on civil litigation, ADR, lawyers' professional conduct and insurance-related subjects. He is the author of Wilkinson's Professional Conduct of Lawyers in Hong Kong (LexisNexis, 2026); Mediation and ADR Confidentiality in Hong Kong (Wildy, Simmonds & Hill Publishing, 2019); and Halsbury's Laws of Hong Kong volume on Limitation of Actions (LexisNexis, 2015). He is a contributing author to A Guide to Civil Procedure in Hong Kong (LexisNexis, 2023); Research Handbook on Marine Insurance Law (Edward Elgar, 2024); and Insurability of Emerging Risks: Law, Theory and Practice (Hart, 2025).
He was the Director of the Faculty's Asian Institute of International Financial Law (AIIFL) from 2015-2019 and served as Deputy Head of the PLE Department from 2009 to 2012.
Gary is a member of the Hong Kong Law Society's Insurance Law Committee. He is also serves as Convener for Head IV (Accounts & Professional Conduct) of the Law Society's Overseas Lawyers Qualification Examination (OLQE). |
Outline:
The course will cover recent developments in civil procedure including:
- Appeals- Jovial Paradise Ltd v Ever Harmony Enterprises Ltd [2026] HKCA 1154 on whether fresh evidence was admissible in an appeal.
- Artificial Intelligence - the Hong Kong Law Society's Generative AI in Legal Practice - Risks and Tips as it relates to civil procedure and the Judiciary's anticipated guidelines.
- Case management - Liao Chen Toh v Loyal International Enterprises Co Ltd & Ors [2025] 6 HKC 193 on the timing of ‘close of pleadings'.
- Commencement of Proceedings - Practice Note - Use Of The Integrated Court Case Management System For Case Commencement In The High Court in preparation for the mandatory use of iCMS in the last quarter of 2026.
- Contempt - Ho Yuk Wah David [2026] HKCFI 3589 concerning an application for leave to commence contempt proceedings on basis of making a false statement in an affidavit.
- Courts - the Hong Kong Judiciary's creation of the Hong Kong International Commercial Court (HKICC), a specialist division of the High Court, which will adjudicate on complex, high-value international and cross-border commercial disputes.
- Discovery - China National Gold Group Hong Kong Limited v The Hongkong and Shanghai Banking Corporation Limited [2026] 1 HKC 487 on whether a Norwich Pharmacal order was ‘necessary and proportionate'.
- Expert witnesses - Chow Chi Yi v Poon Tak Lun [2026] 3 HKC 1034, the court held that the appointment of a single joint expert does not per se preclude a party from seeking leave to adduce its own expert evidence to challenge that single joint expert.
- Mareva Injunctions - China Evergrande Group (in liquidation) v Xia Haijun & Ors [2026] HKCA 15, the Court of Appeal refused leave to appeal against continuation of a Mareva injunction.
- Sanctioned offers- Lin Ruiqing v Yung Run Yew Daniel [2026] HKCFI 3294, [2026] HKEC 3988, on whether it was unjust to order a defendant which refused a sanctioned offer to pay indemnity costs and enhanced interest
- Security for Costs - P1 & Anor v D [2025] 2 HKC 50, the Court of First Instance ordered security for costs against the plaintiffs who had applied to set aside an arbitral award.
- Service of proceedings - the April 2026 Arrangement on Mutual Service of Judicial Documents in Civil and Commercial Proceedings between the Mainland and the Hong Kong Special Administrative Region, which replaces the previous 1999 arrangements with, inter alia, an increase in the modes of service.
- Summary Judgment- BCPE Diamond Holdco SRL v Sunwe Plastic HK Ltd & Ors [2025] 2 HKC 415 on the entitlement to summary judgment in a claim for unjust enrichment.
- Unless Orders - FA v Torture Claims Appeal Board/Non Refoulement Claims Petition Office [2026] HKCA 1048 in which the court refused relief from sanction for non-compliance with an unless order.

Bookings & Payments
To reserve a seat, please fax the completed booking form to us. We will send out a written Booking Confirmation either by fax or by email to confirm your booking, normally within 48 hours after receiving the booking form. Payment should be made upon we send the Booking Confirmation to you, or together with the booking form if the booking is received within seven (7) days of the course. You are advised to contact us to confirm your place if you have not received the Booking Confirmation prior to the commencement of the course.
Cancellation
In case of cancellation of a booking, you must inform us in writing at least seven (7) days before the date of the course, and a full refund will be issued (less of HK$300 administration fee). Cancellation of unpaid bookings will incur a HK$300 administration fee and the cancellation will not be deemed effective until payment of such fee is received. No refunds will be given and any outstanding amounts remain payable in full if the written notice of cancellation is made less than (7) days before the date of the course.
Transfer
If you cannot attend a booked course, you must inform us in writing at least 24 hours before the commencing time of the course. You may then:
- Transfer the booking to a replacement delegate;( Not available for Individual Discount Packages)
- Transfer your booking to another course, to be held before 31 October 2026; or
- Request a credit voucher, to be used on another LexOmnibus CPD course to be held before 31 October 2026.
No attendance
Once a booking is confirmed and no written notice of cancellation is received by us within the specified time as mentioned above, if a delegate has not settled the payment for a course and fails to attend, for whatever reason, the course fee will remain payable in full. To be awarded CPD points, full attendance of all parts of the conference is required. If you arrive later, or fail to attend a course, your course fee will not be waived, refunded or a credit voucher issued.
Weather
In the event that the No.8 typhoon signal is hoisted or the Black Rain Storm warning is raised within 2.5 hours of the course or is due to be raised during the course, the course will be cancelled. In the event of cancellation due to bad weather, the course will be rescheduled or a credit note issued. No refunds will be given.
Record of Attendance
A certificate of attendance can be provided at a cost of HK$40. Alternatively, a verification of attendance in letter format, along with the original payments receipt is available, at a cost HK$40. Please apply in writing to request either a certificate or verification letter subsequent to the course.
Conference Venue
All the conferences, except webinars, will be taken place in Central. The address of the conference venue will be notified by email, and via the website.
Other Terms
- We may reschedule, vary the details of a course at any time without liability. If we cancel or reschedule the course, except due to the weather conditions indicated, a credit note will be issued.
- Any bank charges and/or expenses incurred as a result of bounced cheques shall be borne by the delegates.
- LexOmnibus will not issue an invoice for registration of a course except under special circumstances and LexOmnibus reserves the right to charge an administration fee for providing that service.
