Presenter's Biography:

Angela has a broad commercial chancery practice, representing corporations and individuals in complex disputes. Her core practice areas are company and commercial, probate, family trust, and defamation. Her expertise also extends across personal injuries and fatal claims, death inquests, property disputes, securities and finance, professional disciplinary actions, as well as injunctions.

Aside from litigation, Angela is a Fellow of the Chartered Institute of Arbitrators and she obtained the 2023 Diploma in International Commercial Arbitration from the CIArb. Angela has experience of acting for parties in commercial and aviation arbitrations. She is on Bar List (Arbitrators) of the Bar Association.

Angela is regularly instructed as sole counsel to advise and to appear in courts and tribunals. She is equally at home acting within counsel teams.

Angela served as a member of the Investment Committee of The Bar Council from 2019 to 2024. She is also a member of the Panel of Advisor of the Office for Film, Newspaper and Article Administration, and a Member of the Social Workers Registration Board's Disciplinary Committee Panel.
 
Objective:

This course aims to provide participants with a clear understanding of how traditional defamation principles are applied and challenged in the digital environment. It will explore the legal complexities arising from social media, anonymous online publications, and the viral nature of internet content. Participants will also gain practical strategies for managing and mitigating the risks associated with online defamation.
The seminar will further highlight jurisdictional challenges, enforcement difficulties, and emerging legal standards specific to online publications. Through examining real-world examples and comparative case law, participants will develop a nuanced appreciation of how defamation law must evolve to address the unique features of the digital landscape.

  • Overview of fundamental legal principles of HK Defamation Law.
  • Unique features of online defamation:
    • Speed, scale, and permanence of online publications.
    • Anonymity and jurisdictional challenges.

  • Key Hong Kong cases involving online defamation.
  • Comparing Hong Kong with other common law jurisdictions (e.g. UK, Australia, US).
  • Defenses in online defamation (e.g., innocent dissemination, public interest).
  • Remedies and enforcement issues in digital defamation cases.
  • Emerging trends and future outlook.
