Presenter's Biography:

Angela has a broad commercial chancery practice, representing corporations and individuals in complex disputes. Her core practice areas are company and commercial, probate, family trust, and defamation. Her expertise also extends across personal injuries and fatal claims, death inquests, property disputes, securities and finance, professional disciplinary actions, as well as injunctions.

Aside from litigation, Angela is a Fellow of the Chartered Institute of Arbitrators and she obtained the 2023 Diploma in International Commercial Arbitration from the CIArb. Angela has experience of acting for parties in commercial and aviation arbitrations. She is on Bar List (Arbitrators) of the Bar Association.

Angela is regularly instructed as sole counsel to advise and to appear in courts and tribunals. She is equally at home acting within counsel teams.

Angela served as a member of the Investment Committee of The Bar Council from 2019 to 2024. She is also a member of the Panel of Advisor of the Office for Film, Newspaper and Article Administration, and a Member of the Social Workers Registration Board's Disciplinary Committee Panel.
 
Objective:

This course is designed to examine the major recent case law and legislative developments that have shaped online defamation. Participants will analyze how courts are adapting traditional defamation concepts to the internet age, and identify emerging trends and best practices. The course will equip practitioners with insights into how evolving standards impact the handling of online defamation disputes.

By studying significant Hong Kong decisions alongside international developments, participants will better understand how key legal issues—such as intermediary liability, serious harm thresholds, and freedom of expression—are being reconsidered in the online context. The course will also offer practical commentary on how these developments affect litigation strategy and risk management.

    • Speed, scale, and permanence of online publications.
    • Anonymity and jurisdictional challenges.

  • Key legal developments:
    • Approach to serious harm threshold.
    • Treatment of intermediaries (e.g., platforms, website operators).
    • Trends in damages awards for online defamation.

  • In-depth discussions of recent significant online defamation cases (Hong Kong and internationally).

  • Comparative review: UK's Defamation Act 2013, Australian reforms, US "actual malice" standard.

  • Practical implications for claimants and defendants.

  • Best practices for managing online defamation risks in a changing landscape.

  • Future directions: AI-generated content, deepfakes, and platform liability.
