Presenter's Biography:

Enzo WH Chow was formerly a solicitor and working as a Government Counsel with the Department of Justice, specialized in civil litigation (including a wide range of land disputes involving the Government, tax cases, mental health cases, and public law family cases). He left the Department of Justice and became a barrister in 2006 specialized in family litigations, contentious probates matters, disputes relating to mental capacity and property and trust disputes. Enzo has been a contributing editor to the Hong Kong Civil Procedure (the Whitebook) since the publication.
 
Objective:

To enable the attendees to understand the Common Law principles relating to enforcement of foreign civil judgments in Hong Kong and the current mechanism in place in Hong Kong for the recognition and enforcement of judgments in civil and family matters rendered by the Courts of Mainland China
 
Outline:

  • Recognition and enforcement of foreign civil judgments at Common Law.
  • The mechanism of reciprocal recognition and enforcement of civil judgments under the Mainland Judgments (Reciprocal Enforcement) Ordinance (Cap.597) between the Mainland and Hong Kong.
  • The mechanism of reciprocal recognition and enforcement of judgments in family and matrimonial matters under Mainland Judgments in Matrimonial and Family Cases (Reciprocal Recognition and Enforcement) Ordinance (Cap. 639).
  • The mechanism of reciprocal recognition and enforcement of civil judgments under the Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance (Cap.645).
