Presenter's Biography:

Ms. Lau Wan-ching was admitted as a Barrister of the High Court of Hong Kong, China in 2007. Her practice covers civil law, commercial law, family law, and criminal law (has experience to act for prosecution and defence respectively) in Hong Kong, China, and has experience in conducting litigation and appeals. In addition, Ms. Lau is qualified as a Guangdong-Hong Kong-Macao Grater Bay Area (GBA) Lawyer and Mediator. She is also the Member of the Chartered Institute of Arbitrators (MCIArb), the Dual Qualification Arbitration Tribunal Secretary of Shenzhen Court of International Arbitration (SCIA) & South China International Arbitration Center (HK) (SCIAHK), the Certified International Arbitrator (CIAB) of International Dispute Resolution & Risk Management Institute (IDRRMI), Part-time Arbitrators from Hong Kong and Macao of Guangzhou Labour and Personnel Dispute Arbitration Commission, PRC, Arbitrator of Greater Bay Area International Maritime and Commercial Mediation Center, Arbitrator of Shanwei Arbitration Commission, PRC and Arbitrator of Wuhan Arbitration Commission, PRC. Furthermore, Ms. Lau is also an accredited mediator in Hong Kong, China, with expertise in civil and commercial, family, sports ((HKMAAL) General/Family, (AALCO) Med, Sports Med; (IDRRMI, MHJMC) IAPM). Since 2000, Ms. Lau has delivered lectures to various departments of the Government of Hong Kong Special Administrative Region and to local universities, also provide CPD courses, seminars, and workshops to private sector. She is also a co-author of the Annotated Ordinances of Hong Kong: Factories and Industrial Undertakings Ordinance (Cap 59), 1st issue, and the Annotated Ordinances of Hong Kong: Road Traffic Ordinance (Cap 374), 1st and 2nd issues, published by LexisNexis, Hong Kong. Prior to her legal career, Ms. Lau gained experience in television broadcast journalism in Hong Kong, serving as a news anchor and senior news reporter for TVB News and Cable News channels.
 
Objective:

In recent years, legal challenges concerning the management of multi storey buildings in Hong Kong have grown increasingly complex. They now extend beyond conventional disputes among owners, or between owners and Incorporated Owners (IOs), to broader questions about the scope of IOs' statutory powers and duties in relation to common areas and major repair works. In parallel, the Hong Kong courts have delivered significant judgments affecting landlord tenant relations, with notable implications for legal practice. Alongside these developments, there has been an observable shift towards the use of alternative dispute resolution mechanisms—particularly mediation and arbitration—as a preferred means of resolving building management and tenancy disputes, rather than resorting to litigation. This trend has become an increasingly important consideration in legal advisory work. This course is designed for legal practitioners (including solicitors, barristers, and in house counsel), as well as other professionals. It provides a structured overview of the up to date statutory framework and recent significant Hong Kong judicial decisions relating to building management and landlord and tenant law and also examines key practical issues in preparing for mediation and arbitration. Upon completion, participants will be better equipped to enhance their professional competence and effectiveness in handling related proceedings in Hong Kong, while staying current with recent judicial developments that directly affect day to day legal practice in this area.

Topics covered on this course will include:

  • Highlight the key governing ordinances and regulations, and the rights and obligations relevant to building management disputes (including the role of Incorporated Owners), as well as landlord and tenant matters

  • Discuss recent relevant court decisions and practical takeaways for legal practice including the use of expert evidence

  • Provide practical guidance on preparing for alternative dispute resolution (mediation and arbitration)
