Presenter's Biography:

Louis TH Cheng is a qualified barrister, clinical psychologist, and IT professional with a multidisciplinary practice focused on the intersection of human behavior, technology, and the law. He maintains a mixed civil and criminal practice, having appeared as an advocate in all levels of court up to the Court of First Instance.
Prior to joining the Bar, Louis spent years within multinational technology corporations, specializing in IT auditing, cybersecurity advisory, and tech consulting. This technical foundation allows him to navigate complex digital evidence and AI governance issues with a level of insight rare in the legal profession. Complementing his legal and tech expertise, Louis is a trained mental health counselor experienced in psychological assessment and psychotherapy. By synthesizing these diverse fields, Louis provides a holistic, logic-driven approach to advocacy, whether representing clients in court or advising on the ethical architecture of emerging technologies.
 
Objective:

As Hong Kong transitions from a "soft" ethical framework to a more rigorous, risk-based auditing environment, corporate officers and legal practitioners must move beyond simple privacy compliance. This session focuses on the "Data Integrity" mandate: the legal obligation to ensure that AI inputs are not "poisoned" and that autonomous agents operate within the bounds of corporate fiduciary duty.
 
Outline:

  • A deep dive into Data Stewardship Values: Why "Accountability" now requires a documented audit trail of training data origins.

  • Data Poisoning: If an AI's output causes harm due to a "poisoned" dataset (maliciously manipulated training data), does the corporation meet the "Reasonable Standard of Care" if they failed to audit the data pipeline?

  • Prompt Injection: Assessing liability when an autonomous agent is "tricked" into bypassing its legal guardrails.

  • The "Human-in-the-loop" requirement: At what stage of an autonomous decision must a human intercede to maintain legal privilege and corporate protection?

  • The SFC's stance on Algorithmic Trading & Market Manipulation: When a "reckless" algorithm triggers a regulatory investigation.

  • Updates on the Law Reform Commission's study on Cyber-enabled Crimes: Will "misuse of AI" become a standalone aggravating factor in HK sentencing?
